Terms of Service

1. Who we are, and what this covers

Tripo GameForge (“GameForge”, “the service”) is operated by Vexstorm Studios (“we”, “us”), based in New Castle, Delaware, United States. These terms cover the GameForge website, the browser game, and the event leaderboards. Tripo is our 3D model provider and event partner; Tripo does not operate the service and is not a party to these terms.

By creating an account you agree to these terms and to the Privacy Policy. If you do not agree, do not create an account — you can still play.

2. Playing without an account

You do not need an account to play. The whole game is available to anyone. An account exists for one reason: to put a score on a public leaderboard under a name that can be attributed to you.

3. Who may hold an account

You must be at least 13 years old to create a GameForge account. If you live in the European Economic Area or the United Kingdom, you must be at least the digital age of consent set by your own country, which in some countries is higher than 13. We ask for your birth month and year before an account is created and we do not store them — see the Privacy Policy.

If you are under 18, you may only hold an account if a parent or guardian knows about it and agrees to it, including to your display name being shown publicly. We ask you to confirm this when you register. You are also never required to give a Discord username.

One person, one account. Do not create an account for someone else, and do not share your sign-in details.

5. Display names and public content

Your display name and, if you supply one, your Discord username are shown publicly on the leaderboard. Choose a display name accordingly. Do not use a name that impersonates someone else, harasses anybody, contains slurs or sexual content, or that you do not have the right to use. We may change or remove a display name that breaks this rule, and we may suspend the account behind it.

6. Fair play

Events are competitions, and a leaderboard is only worth anything if the numbers on it are defensible. So, while playing:

We check submitted runs for plausibility and keep an audit record of submissions. We may reject a run, remove a leaderboard entry, or suspend or close an account that breaks these rules. Where a result is disputed we will explain the reason for our decision.

7. Events, prizes and availability

Events run for a stated period and each has its own rules, which are shown on the event page. We may open, close, extend, pause or cancel an event, and we may change the service or take it down for maintenance. Where an event offers a prize, the rules for that prize are published with the event; nothing in these terms is itself an offer of a prize.

The service is provided as it is. We do not promise it will be uninterrupted or error-free.

8. Intellectual property

GameForge, its code, its artwork and its branding belong to Vexstorm Studios or to our licensors, and 3D models supplied through Tripo remain the property of their respective owners. You may play the game and share screenshots and recordings of your own play. You may not copy, resell, decompile or redistribute the software, or use our branding to suggest we endorse something we do not.

Your display name remains yours. By registering you allow us to show it, and your scores, on the public leaderboard for the events you enter.

9. Ending your account

You can delete your account at any time from My Account. Deletion is scheduled 7 days ahead and you can cancel it during that window. After it runs, your account is anonymised as described in the Privacy Policy; past scores remain on historical leaderboards under “Deleted Player”, because removing them would rewrite the results of a competition other people also took part in.

We may suspend or close an account that breaks these terms. Where we can, we will tell you why.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for loss arising from your use of the service. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing in them affects the statutory rights of a consumer.

11. Changes to these terms

Each version of these terms carries a version string, shown at the top of this page, and the version you agreed to is stored with your account. If we make a material change we will publish the new version here and raise that version string. Continuing to use your account after a change means you accept the new version; if you do not, you can delete your account.

12. Governing law and disputes

Talk to us first. Almost everything is quicker to fix by email than by anything else, so before starting a formal dispute please contact support@vexstorm.com and give us a fair chance to put it right.

These terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules, and any dispute that cannot be resolved between us will be heard by the state or federal courts located in Delaware. You and we each agree to that jurisdiction.

If you are a consumer, this does not take anything away from you. Where the law of the country you live in gives you rights that cannot be signed away by an agreement like this one — including the right to bring a claim in your own local courts, and the protection of your own country's mandatory consumer and data-protection law — those rights still apply in full, and nothing in this section limits them.
